The service fees consist mainly of an administrative fee and remuneration for the mediators, which allow for a great deal of flexibility, particularly with regard to counselling services. More than 100 CLO of centrally administered SOEs, CEO of listed companies, professors, retired judges, lawyers and/or gold medal mediators have participated in CIMAI's cross-disciplinary mediation brand training to master international and domestic mediation skills. Together with CIMAI's team of expert consultants and especially invited mediators who come from multiple jurisdictions of the world, they will provide solo mediation or "co-moderated mediation" services both online and offline.
Mediation RulesThe CIMAI Mediation Rules have been developed with reference to the United Nations UNCITRAL Mediation Rules (2021) - which focus on risk prevention of mediation and the effectiveness of cross-boarder enforcement.
Arbitration usually arises from the agreement between the parties (arbitration clauses are commonly found in contracts or investment agreements), such as entrusting CIMAI to administer the international arbitration with reference to CIMAI's Model Clause (appointing one or more arbitrators to form the arbitral tribunal), or having CIMAI recommend international arbitrators to facilitate Ad Hoc arbitration, or using the mechanism of investment arbitration to resolve disputes.
International arbitration can be divided into institutional arbitration and Ad Hoc arbitration, and CIMAI currently promotes Ad Hoc arbitration (online case handling of institutional arbitration is encouraged). CIMAI provides services such as guarantee/margin custody; in addition, relevant consulting services are provided.
The type of case handling will focus on cross-border disputes (especially those involving centrally administered state-owned enterprises and/or multinational enterprises), the“foreign-related elements”of the Mainland parties, such as commercial disputes with Hong Kong, Macau/other jurisdictions.
Request for Arbitration: Case@cimai.orgServices that CIMAI assists and promotes services in ad hoc arbitration, such as recommending/appointing international arbitrators, providing security funds or other escrow services; when case management and/or secretarial services are provided, a "Case Registration Fee","Institution Service Fee/Administrative Fee” and arbitrator's remuneration will be charged, as provided in the relevant price list or individual fee. Consulting fees are agreed upon on the basis of the needs of the parties.

Where a dispute is to be resolved through mediation or arbitration the parties usually reach a mediation agreement, an arbitration agreement or an agreement between the parties to undertake mediation before the dispute is submitted to arbitration.
If the parties agree that the China International Mediation and Arbitration Institute Limited (also known as HK CIMAI or CIMAI) will manage and facilitate the dispute resolution, it is recommended to include a Model Clause in the contract.
The Model Clause can be varied, and CIMAI will provide targeted consulting services according to the needs of different customers.
This Model Mediation Clause is mainly applicable to international commercial mediation, and CIMAI's Mediation Rules of China International Mediation and Arbitration Institute are derived from the UNCITRAL Mediation Rules. From the perspective of mediation skills, CIMAI's international commercial mediators are also able to resolve disputes in Chinese mainland.
International mediation is divided into general commercial mediation and Investment Mediation, and this Model Mediation Clause mainly applies to general commercial mediation. As to Investment Mediations and other matters, CIMAI will provide assistance through targeted advisory services.
This Model Arbitration Clause is mainly applicable to international commercial arbitrations, and the UNCITRAL Arbitration Rules, which CIMAI recommends for application, is recognized as one of the most effective rules in ad hoc arbitration.
International arbitration is divided into general commercial arbitration, investment arbitration and inter-state arbitration, and this Model Arbitration Clause will mainly apply to general commercial arbitration, and the New York Convention will be used for enforcement (the Washington Convention is more commonly considered in investment arbitration), and CIMAI will provide assistance through targeted advisory services.
This clause is one of the clauses appreciated by CIMAI, which is especially applicable to the centrally administered state-owned enterprises or multinational enterprises in Chinese mainland. Perhaps different from some advanced jurisdictions, “Mediation-Arbitration-Litigation” attaches importance to the effectiveness of safeguarding rights, which is an intrinsic requirement of CIMAI's case-handling and training brand. In this regard, the parties can maximize their demand for safeguarding rights through CIMAI's targeted advisory services.

In April 2023, CIMAI's International Mediation Training, with the support of the Guangdong Lawyers Association, has held a number of senior training courses for international commercial mediator qualification certificates recognized in Hong Kong and the Chinese Mainland. The participants include the general counsel of centrally administered SOEs, CEOs of listed companies, retired judges, law firm directors and university professors, as well as case managers of well-known arbitration institutions. The effective teaching allows the participants from all over the world to quickly master the practical skills in domestic and foreign mediation.
At the beginning of the new year, CIMAI's traditional "good start" training, with the strong support of the China Investment Association, added compliance elements. The unique "Enterprise ADR & Compliance" International Commercial Mediator Qualification Certificate Advanced Training Course (Phase II) will be launched in 2024.
CIMAI's international arbitration training focuses on practical operations, supplemented by cutting-edge jurisprudence; With the support of the characteristics of CIMAI training brand, we strive to the maximize the effectiveness of training.

In the past five years, CIMAI's activities have mainly included two categories: international forums and visits and exchanges. CIMAI's international forums promote mediation and arbitration, share international cutting-edge theories and case handling practices, and have a good social impact; Among them, the mutual recognition of international mediation certificates has brought enlightenment to the mutual recognition of certificates in the professional field.

Mutual Recognition of International Commercial Mediation CertificatesCIMAI's international mediation training follows the mainstream international model of Hong Kong and strictly controls the effectiveness of the courses. The quality of the course certificate has been recognized by another mediation and arbitration institution in Hong Kong. At the International Forum held on 19 August 2023, CIMAI and HKMAAC signed an agreement on mutual recognition of certificates, and the Chairman Dr. Lai and Chairman Albert So presented their respective international commercial mediator certificates to the successful applicants.
CIMAI, together with the China-ASEAN (Macau) Arbitration Association, chambers of commerce, mediation and/or arbitration institutions, has organized a number of international forums and academic salons on mediation and arbitration in Macao in recent years.
The forums were sponsored by the government and attended by experts and scholars from well-known mediation institutions, arbitration institutions, universities, law societies, bar associations, commercial enterprises, and/or mediators and arbitrators from various jurisdictions. Participating institutions include the ICC, the Chartered Institute of Arbitrators (East Asia Branch), the Singapore International Arbitration Centre (SIAC), and the Singapore International Mediation Centre, etc.
